Cybersecurity and prevention of computer crimes pursuant to Legislative Decree 231/2001

Abstract

Cybersecurity issues cannot (and must not) be considered isolated issues but they necessarily see the mixing and involvement with other matters, exposed to the same security and protection issues. With the introduction of computer crimes in the category of predicate offenses referred to in Legislative Decree 8 June 2001, no. 231, (so-called “Decree 231”), the regulatory scenario on cyber matters has further expanded and enriched.

Information and Communications Technology (so-called ICT) is a world of technical complexity and practical versatility, so much so that information technologies and the network have now become indispensable tools for everyone. The concrete usefulness and substantial advantages are offset by the growing exposure to intrusions and computer attacks that undermine the security of the data processed and the technical, commercial and industrial information available to each organization.

For some years, in fact, the development of the sector and the creation of refined and functional technologies have been proceeding hand in hand with the management of the connected risk factors which, unfortunately, have taken on an increasingly consistent dimension.

Alessandro Livi, graduated with honors from the University of Rome “Tor Vergata” with a thesis in Comparative Private Law entitled: “International copyright in the digital society, between new protections and new conflicts”. PhD student at the University of Rome “Tor Vergata”, Alessandro is also an expert in the subject of Comparative Private Law at the aforementioned University as well as Market Law and Regulation at the LUISS Guido Carli University. Erica Onorati, graduated in law from the LUISS Guido Carli University in Rome with a thesis in civil law entitled “The renegotiation clauses”, focused on the analysis and applicability of the renegotiation in contractual matters. Specialized in the civil law profile, she has studied issues related to contractual and extra-contractual liability and corporate and commercial law. After several experiences in the legal field in corporate contexts as a corporate lawyer, you currently hold the role of Junior Legal Counsel in Telsy. with a focus on the management of business contracts and legal advice provided to the business lines involved in the various sectors of business operations.
